How to employ foreigners

Basic information on the employment of foreigners

Employing workers with foreign nationality is usually more administratively demanding. If a position can be filled by a foreign worker, please contact Bc. Karolína Doncová from the Welcome Office. You will find out how long the process can take and what it will entail. 

 

Foreign nationals who can be employed almost immediately (approx. within 14 days)

  • citizens of the EU, EEA and Switzerland
  • family members of EU citizens
  • students from third countries with a residence permit (n this case the number of hours should not exceed 0.6)
  • graduates of Czech high schools and universities with a Czech diploma
  • foreigners with permanent residence in the Czech Republic
  • foreigners granted asylum or subsidiary protection
  • foreigners from third countries with a residence permit issued for the purpose of scientific and research activities from another EU, EEC and Switzerland state

 

Holders of employee cards can be employed in approx. 2 - 3 months

  • foreigners from third countries currently residing in the Czech Republic

Foreigners in the country of origin can be employed in 4 - 10 months (depends on the job position and the country of origin)

  • foreigners from third countries currently residing in the country of origin

→ Each case is individual, so always consult the Welcome Office about the possibility of employing foreigners at MENDELU. For the consultation, please prepare information regarding the job position (academic x scientific-research), country of origin and holding visa from another EU member state.

 

What to look out for when employing foreigners (applies to all the above categories)

It is important to find out if the future employee has another job in another EU country, EEC or Switzerland. If so, it is necessary to submit an application for an A1 form, aka Certificate concerning the Social Security legislation. The application is submitted in the country of the foreigner's permanent residence, or temporary residence, where he/she stays most of the time or where family members live (meant an EU country).

 

Mandatory details of the application for issuing A1:

  • completed form (each country has its own form)
  • a copy of the employment contract/contracts from all jobs in the EU related to the timeframe (employment relationship and all types of agreements), the last amendment to the contract must always be attached
  • copy of valid A1, if issued and related to the timeframe

The application must be sent as soon as possible and the decision must be handed over by the time of the first contributions. In case of further questions related to A1 form, you can contact Ing. Leona Abudayyehová.

 

How to fill out A1 form:

The A1 form is mandatory to send to social security institution in which country of EU a new employee currently reside (their family reside), no matter where he/she spends more time working. In case of CZ, they are oblidged to fill out the Czech version of the application since the offical language is Czech. Other onboarding requirements, such as an entrance medical examination, health and safety training, are carried out in the same way as for domestic employees.
